Arbitration and mediation are two forms of alternative dispute resolution used to settle conflicts outside of traditional court litigation. Arbitration involves a neutral arbitrator issuing a binding decision after hearing both sides, while mediation involves a neutral mediator facilitating negotiation to help parties reach a voluntary agreement. Both are widely used by attorneys, HR professionals, and businesses to resolve disputes more quickly, privately, and cost-effectively than going to trial.
